Quick Referance Guide of Association Information

BULLRUN TOWNHOUSE ASSOCIATION

RULES FOR ALL RESIDENTS (HOMEOWNERS AND RENTERS)

WELCOME! The Bullrun Townhouse Association is a planned unit development of privately owned lots and homes, where residents live in relatively close proximity and share use of common grounds. In addition, the Association has placed on it by its governing documents certain responsibilities to maintain the structural integrity, appearance, and liveability of the neighborhood. These rules are very brief summaries from the Association's Declaration (D), Bylaws (B), and Policies (P).

1. Parking

a. Each household should be limited to two vehicles, to be parked in the unit's garage or carport, not in visitor parking. (B)

b. Residents may request temporary alternate parking from the Board of Directors. (D)

c. House trailers, trucks, campers, mobile homes, boats, or boat trailers must be parked in garages or in the RV parking area, unless otherwise approved. (D, B)

d. The Lot Manager assigns RV parking spaces as space allows – one per resident with a RV. (B, P)

e. Parking areas may not be used by non-operative vehicles, or for vehicle repairs. (P)

f. Commercial vehicles are not to be parked anywhere, unless loading or unloading. (P)

g. Cars shall be parked so as to allow through traffic, especially of emergency vehicles. (P)

2. Washing of non-resident vehicles in the complex is not permitted. (P)

3. Pets

a. House pets are the only animals allowed. (D)

b. Dogs and cats are limited to two per household, and must be kept on a leash at all times when outside. (D)

c. Pet owners must remove their pet's excrement from common areas. (B)

d. Owners of dogs must not allow their dogs to disrupt neighbors by excessive barking. (B)

e. Pets may not be tethered within the common grounds. (P)

4. Garbage

a. Garbage must be screened from public view (D)

b. Garbage pickup of one can per household is paid by the Association, any extra charges or deposits for cans owned by the garbage company will be paid by the homeowner. (P)

5. The use of lawns for riding bicycles, tricycles, or wagons is not allowed. (P)

6. The use of property must be solely of a residential nature. (D) No garage or carport may be used as a warehouse or made part of the living area. (B)

7. Planting

a. Trees within courtyards must not be higher than garage roof level. (P)

b. Trees and shrubs within courtyards must be no larger than a six-inch trunk diameter, and no closer than three feet to the foundation, and must be trimmed away from walls and fences. (P)

c. The Landscape Committee must approve plantings on the common ground, and perennials become the property of the Association for maintenance. (P)

d. Trees or other vegetation must not interfere with the view of residences. (D)

8. The Community Room may be rented by homeowners for a fee of $10 for each use. (P)

9. One swimming pool key may be issued per unit with a $2 deposit. (P)

10. Garage sales are limited to two per home per year for no longer than 3 days each. (P)

11. Appearance of Homes

a. No building materials may be stored on any property until the owner is ready to start construction. (D)

b. No noxious or undesirable thing is permitted on the property. (D)

c. No signs may be erected, posted, painted, or displayed on any building, except for one sign no larger than 400 square inches to advertise property for rent or for sale. When a home is for sale, freestanding Open House signs may be placed on common ground for no longer than 4 hours, no longer than 2 days in a row, or less than 5 days apart. (D, P)

d. Clotheslines must not be visible from the driveway, other dwellings, or public areas. (D)

e. Exterior lighting visible from the street, parking area, or other dwellings must not be installed permanently without written permission from the Architectural Control Committee. Temporary holiday lights may be installed for up to 30 days before the holiday and 30 days after the holiday. (D, P)

f. Antennae or satellite dishes are not permitted on exterior walls or roofs, and 18" or smaller dishes may be approved if on a freestanding post. (P)

g. Solar panels are not permitted. (P)

h. Installation of an air conditioner/heat pump in an enclosed patio area is approved if it is not on common ground. Flush mounted wall or window air conditioning units are approved. (P)

i. Cable TV cable may be installed on the exterior of a unit for second floor access in a manner similar to those presently installed. (P)

j. Carports may only contain the occupant's car, and firewood that is stacked at least 6" from any wall. (P)

k. Homeowners may install storm windows and storm doors as long as the color is pre-approved; the Association is not responsible for their maintenance. (P)

l. Front door, walk-in garage door, and steel garage door repairs and replacements are the responsibility of the homeowner, and must be replaced by doors of equal quality. (P)

12. Maintenance Responsibilities

a. Maintenance by the Association consists of the exterior surfaces of dwellings, the common area, utility lines in the common area, with the right of access to these areas for maintenance. Exterior maintenance is as follows: paint, repairs, roofs, gutters, downspouts, exterior building surfaces, trees, shrubs, grass, walks, and does not include glass surfaces. (D)

b. The homeowner is responsible for all interior maintenance, repair, and replacement. (P)

c. Extermination of vermin, pests, and birds within exterior surfaces, chimneys, and property lines are the homeowner's responsibility. (P)

d. Maintenance of exterior lighting on carports, garages, streets, and other common areas is the responsibility of the Association. The Association maintains Exclusive Use Areas (e.g. entryways, stairs, decks on common ground). The Association maintains concrete pads on common ground. (P)

e. Homeowners are responsible for damage to personal property or contents of a unit (e.g. furniture, clothing) even if such damage is caused by a casualty loss covered by the Association’s insurance policy. (P)

f. Homeowners are responsible for repairs to their building or garage foundation. (P)

g. The Association maintains siding, fencing, gutters, downspouts and water lines in enclosed patios; homeowners maintain all other improvements within enclosed patio areas. (P)

13. Remodeling plans for the interior or exterior of units must be approved by the Architectural Control Committee. The Committee's decisions may be appealed to the Board of Directors. (D)

14. Utility line installation or repair (e.g. a new phone line) that may require burying of lines or pipes or digging on common ground requires 72 hours notice to the Association. (P)

15. Penalty for violation of the Association's rules is a fine of $50 after the second warning. (P)
